1. Acceptance of Terms

By accessing or using BuiltPro ("the Service"), operated by Elyron Group, LLC, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including contractors, subcontractors, clients, and any other parties accessing the platform.

2. Description of Service

BuiltPro is a cloud-based construction project management Software-as-a-Service (SaaS) platform that provides tools for project tracking, client relationship management (CRM), estimating, invoicing, scheduling, field operations, document management, and related functionality for construction professionals. The Service is accessible at app.builtpro.app.

3. Account Registration

• You must provide accurate, current, and complete information when creating an account
• You are responsible for maintaining the confidentiality of your login credentials
• You are responsible for all activity that occurs under your account
• You must notify us immediately of any unauthorized use of your account at support@builtpro.app
• You must be at least 18 years old to use this Service

4. User Responsibilities

As a user of BuiltPro, you agree to:

• Use the Service only for lawful purposes and in accordance with these Terms
• Not upload, transmit, or share content that is unlawful, harmful, defamatory, or fraudulent
• Not attempt to reverse engineer, hack, or gain unauthorized access to any part of the platform
• Not use the Service to send spam, unsolicited communications, or violate any anti-spam laws
• Ensure all data you enter about clients and projects is accurate and used with proper authorization
• Comply with all applicable laws and regulations when using the Service
• Obtain proper consent before sending SMS messages to your clients through the platform

5. SMS Communications & Consent

BuiltPro provides SMS messaging functionality for transactional communications between contractors and their clients.

• By providing a phone number within the BuiltPro platform (including through the client portal, estimate approvals, or account registration), users and clients consent to receive transactional SMS messages related to their projects
• SMS message types include: estimates, invoices, appointment reminders, job status updates, and project notifications
• Message frequency varies depending on project activity
• Standard message and data rates may apply based on your carrier plan
• To opt out of SMS messages at any time, reply STOP to any SMS message received
• For assistance, reply HELP or contact support@builtpro.app
• Contractors using BuiltPro are responsible for ensuring their clients have properly consented to SMS communications

6. Subscription & Payment

• BuiltPro offers both free and paid subscription plans
• Paid subscriptions are billed monthly or annually as selected at checkout
• All payments are processed securely by Stripe
• Subscriptions automatically renew unless cancelled before the renewal date
• You may cancel your subscription at any time through your account settings or by contacting support
• Refunds are handled in accordance with our Refund Policy available at builtpro.app/legal
• We reserve the right to change pricing with reasonable advance notice to active subscribers

7. Intellectual Property

All content, features, and functionality of the BuiltPro platform — including but not limited to software, text, graphics, logos, and designs — are the exclusive property of Elyron Group, LLC and are protected by applicable intellectual property laws.

You retain ownership of all data and content you upload to the Service. By using BuiltPro, you grant Elyron Group, LLC a limited license to store, process, and display your content solely for the purpose of providing the Service to you.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. Elyron Group, LLC does not warrant that the Service will be uninterrupted, error-free, or completely secure. Use of the Service is at your sole risk.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Elyron Group, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service, even if advised of the possibility of such damages.

10. Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users, the Service, or third parties. Upon termination, your right to use the Service will immediately cease.

11. Governing Law & Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of the State of North Carolina, United States of America, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in North Carolina, and you consent to personal jurisdiction in such courts.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of material changes via email or through the platform. Your continued use of BuiltPro after changes take effect constitutes your acceptance of the revised terms.
